Because they don’t answer “political questions”, they check for contradictions against the constitution, and they don’t (in their opinion) think there’s any conflicts with the constitution.
Congress could pass a law banning Pizza, and it would be constitutional, however stupid it is.
Yeah, IMO it’s a constitutional question. I’m coming at it from the EFF’s side:
